Libraries have a privilege, under the law, to make up to three copies of materials that are deteriorating for preservation purposes. This conversion of format cannot legally be done simply for the convenience of using a tape recorder, but to preserve a deteriorating copy. The new Digital Millennium Act has further given libraries the privilege of making copies when the format is no longer in manufacture and the playback equipment is no longer available. These privileges are solely for libraries. One cannot perform such activities for classroom collections of materials or for materials simply inventoried by the library, but primarily used in the classrooms.
